Terms of Service
These Terms of Service ("Terms") form a binding agreement between you and KiddieGPT ("KiddieGPT," "we," "us") governing your access to and use of the KiddieGPT web app at app.kiddiegpt.com, browser extension, website, and related services (together, the "Service"). By creating an account, installing the extension, purchasing a plan, or otherwise using the Service, you confirm that you have read and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility & the parent's role
1.1 You must be an adult to set up KiddieGPT
The Service is intended to be installed, configured, and managed by a parent or legal guardian. To install the extension, create a parent PIN, or purchase a subscription, you must be at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter into a contract.
1.2 Children use the Service under supervision
Children in grades K–12 (roughly ages 5–18) may use KiddieGPT only through an account created and managed by a parent or legal guardian and with that adult's knowledge, permission, and appropriate supervision. The Service is built around parent-managed settings and is not intended for a child to create or manage independently.
1.3 You are responsible for your household's use
If you set up KiddieGPT for a child, you accept these Terms on that child's behalf and are responsible for their use of the Service, including any subscription charges and any activity under your installation.
1.4 Accurate account information
You agree to provide accurate, current account and billing information, keep it updated, and create child profiles only for children for whom you are the parent or legal guardian or otherwise have lawful authority. You may not impersonate another person or misrepresent your authority to act for a child.
2. What the Service does
2.1 Description
KiddieGPT is an AI-assisted learning service for homework and practice. Depending on the plan and device, features may include Study Missions, flashcards, quizzes, guided math help, reading and read-aloud tools, writing support, explanations, active-page context, file or screenshot input, phone scanning, and parent controls. Features may change as the Service develops.
2.2 The Service relies on third-party AI
KiddieGPT uses large language models operated by a third-party AI provider (currently OpenAI). The material you submit — such as active-page text, selected text, a pasted question, a file, a screenshot, or a scan — is routed through KiddieGPT's systems to that provider to generate a response. AI output is generated automatically and may be inaccurate, incomplete, outdated, or unsuitable despite our safeguards. Always review important answers and do not rely on the Service as the sole source of truth.
2.3 Not professional advice
KiddieGPT is an educational aid. It does not provide medical, psychological, legal, financial, or other professional advice, and must not be relied on as a substitute for a qualified professional or for a teacher's instruction.
2.4 Content filtering is best-effort
The content filter is a meaningful safeguard, but no automated filter is perfect. It is a tool to assist supervising parents, not a guarantee that a child will never encounter unsuitable content. Active parental supervision remains essential.
2.5 Educational decisions remain yours
AI output is not a grade, assessment, diagnosis, accommodation decision, or official school record. Parents, students, and educators remain responsible for checking work, following school rules, and deciding whether output is appropriate for a particular learner or assignment.
3. Subscriptions, billing & refunds
3.1 Plans
KiddieGPT offers a 7-day free trial that requires a payment method and automatically converts to paid family access unless you cancel before it ends. Paid family access is billed monthly or yearly and covers up to three student profiles. Organization or school enquiries can be made through our contact form. Current prices and included features are listed on our Pricing page, which forms part of these Terms.
3.2 Recurring billing
Paid plans renew automatically at the end of each billing period until cancelled. By subscribing, you authorize us and our payment processor to charge your chosen payment method on a recurring basis. Payments are processed by Stripe; we never receive or store your full card details.
3.3 Price changes
We may change prices. If a change affects your subscription, we will give you notice (by email if we have one on file, and/or via the extension) before the new price takes effect, so you can decide whether to continue.
3.4 Cancellation
You can cancel anytime from your account billing settings or through the Stripe customer portal. After cancelling, you keep paid features until the end of the billing period already paid for. Access may then end or become limited unless another active plan applies.
3.5 Refunds
If you are not satisfied within 7 days of your first family-plan payment, use our contact form to request a refund. Renewal charges are generally refundable only within a short grace period (about 24 hours), and a free trial that converts to paid does not add a separate refund window. After the applicable window, refunds are at our discretion; you can always cancel to prevent future charges. Nothing here limits any non-waivable refund rights under local consumer law.
3.6 Taxes, failed payments & promotions
Prices may exclude applicable taxes. You authorize us to collect taxes where required. If a payment fails, we may retry the payment, limit paid features, or suspend access after reasonable notice. Promotional offers may have additional disclosed terms, may not be combined, and may be changed or withdrawn where permitted by law.
4. Your responsibilities
4.1 Supervise and configure
As the responsible adult, you agree to set a parent PIN (which protects answer reveals and settings), choose an appropriate grade level, review your child's activity periodically, and ensure your child's use is safe and age-appropriate.
4.2 Acceptable use
You agree not to, and not to allow anyone to:
- use the Service unlawfully or to create, request, upload, or distribute content that is abusive, exploitative, sexually explicit, hateful, threatening, fraudulent, or harmful;
- submit another person's personal, confidential, copyrighted, or school-restricted material without permission;
- use the Service to cheat, evade an exam or assignment rule, misrepresent AI output as original student work, or facilitate academic dishonesty;
- attempt to bypass parent controls, safety filters, access controls, rate limits, payment controls, or usage limits;
- probe, scan, or test vulnerabilities; introduce malware; overload or disrupt the Service; or access another account, system, or data without authorization;
- scrape, crawl, bulk-download, benchmark for publication in a misleading way, or use automated means to access the Service except through interfaces we expressly provide;
- reverse-engineer, decompile, disassemble, or extract source code, models, prompts, or underlying components except where that restriction is prohibited by law;
- copy, resell, sublicense, commercially redistribute, or use the Service or its output to build, train, or improve a competing product or AI model; or
- remove ownership notices or misrepresent that KiddieGPT endorses, sponsors, or is affiliated with you.
We may investigate suspected misuse and take proportionate action, including removing content, limiting features, or suspending access. We may report conduct to appropriate authorities when reasonably necessary to comply with law or protect people, rights, or the Service.
4.3 Account & PIN security
You are responsible for keeping your account credentials, parent PIN, license information, and linked devices secure. Notify us promptly through our contact form if you suspect unauthorized access.
5. Intellectual property
5.1 Our rights
The Service — including the extension, website, software, "KiddieGPT" name, logo, owl mascot, visual design, and copy — is owned by KiddieGPT and protected by intellectual-property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your family's own educational purposes.
5.2 Your content
As between you and KiddieGPT, you keep any ownership rights you have in content you provide, including prompts, files, screenshots, selected webpage text, and profile settings. You confirm that you have all rights and permissions needed to provide that content. You grant us and our service providers a worldwide, non-exclusive, royalty-free licence to host, reproduce, transmit, modify, and otherwise process it only as reasonably necessary to provide, secure, maintain, troubleshoot, and improve the operation of the Service, comply with law, and enforce these Terms. We do not use a child's prompts or AI responses to train our own AI models.
5.3 Third-party web content
To provide context-aware features, KiddieGPT may process text from the active webpage, a selected passage, an uploaded file, or a screenshot you choose to submit. Do not submit confidential information or content you do not have permission to use. We do not claim ownership of third-party content.
5.4 AI output
Subject to these Terms and applicable law, you may use output generated for you for your family's personal educational purposes. Because AI systems can produce similar or identical responses for different users, output may not be unique, protectable by intellectual-property law, or free of third-party rights. We do not transfer ownership of the underlying Service, models, prompts, or system components, and we do not guarantee that any output can be copyrighted, patented, trademarked, or used commercially.
5.5 Feedback
If you voluntarily send ideas or feedback about KiddieGPT, you grant us a perpetual, worldwide, irrevocable, royalty-free right to use and incorporate that feedback without restriction or compensation. This does not give us ownership of a child's learning content.
6. Third-party services, links & software
The Service depends on third-party services, including AI, payment, authentication, email, hosting, browser, and operating-system providers. Their own terms and privacy practices may apply to your direct relationship with them. We do not control third-party websites, browser stores, school platforms, or external content linked from or displayed alongside the Service, and we are not responsible for their availability, accuracy, security, or practices. Open-source and third-party software included in the Service may be governed by separate licence terms.
7. Service changes, availability & beta features
We may add, modify, limit, suspend, or discontinue features to maintain security, comply with law, respond to provider changes, control abuse or cost, or improve the Service. We will give reasonable notice when a change materially reduces a paid Service, where practicable. Usage limits, compatible browsers, device requirements, and feature availability may vary by plan, location, age, or device. Preview, experimental, and beta features may be changed or removed at any time and may be less reliable. We are not responsible for delays or failures caused by events reasonably beyond our control, such as internet outages, provider failures, natural disasters, labor disputes, cyberattacks, or government action.
8. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that AI output will be accurate or appropriate in every instance, or that the content filter will catch every unsuitable item. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
9. Limitation of liability
To the fullest extent permitted by law, KiddieGPT and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of (a) USD $100 or (b) the total amount you paid us in the 12 months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
10. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless KiddieGPT, its operator, affiliates, officers, employees, and contractors from third-party claims, damages, liabilities, judgments, and reasonable legal expenses arising from your content, your unlawful or unauthorized use of the Service, or your material breach of these Terms or another person's rights. This obligation does not apply to the extent a claim results from our own negligence, willful misconduct, or violation of law.
11. Suspension & termination
You may stop using the Service at any time, cancel an active subscription, and request account deletion through the app where available or by contacting support. Uninstalling the extension does not by itself cancel a paid subscription. We may suspend or end access if you materially breach these Terms, if required by law, or to protect the Service or its users, with notice where reasonably practicable. Sections that by their nature should survive termination, including Intellectual Property, Disclaimers, Limitation of Liability, and Indemnity, will survive.
12. Copyright complaints
If you believe material available through the Service infringes your copyright, send a notice through our contact form that identifies the copyrighted work, the allegedly infringing material and its location, your contact information, a good-faith statement that the use is not authorized, a statement under penalty of perjury that the notice is accurate and you are authorized to act, and your physical or electronic signature. We may remove or restrict material and may terminate repeat infringers where appropriate. Knowingly making a material misrepresentation in a copyright notice may create liability.
13. Disputes & governing law
13.1 Informal resolution first
Before filing a claim, you and KiddieGPT agree to make a good-faith effort to resolve the dispute informally for at least 30 days. A notice should describe the issue, the relief requested, and the account email involved, and should be sent through our contact form. This requirement does not prevent either party from seeking urgent injunctive relief or filing in small-claims court, and a limitations period is paused during the 30-day informal process where permitted by law.
13.2 Governing law & forum
These Terms are governed by applicable United States federal law and the law of the U.S. state where the KiddieGPT operator is organized, without regard to conflict-of-laws rules. Subject to mandatory consumer-protection law, disputes that are not resolved informally may be brought in a court with jurisdiction where that operator is located. Nothing in these Terms limits non-waivable consumer rights or a right to bring a claim in another forum that applicable law requires.
14. General terms
These Terms, the Privacy Policy, the Pricing page, and any plan-specific terms presented at purchase are the entire agreement about the Service and replace earlier agreements on that subject. If a provision is unenforceable, it will be modified only as much as necessary and the rest will remain effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, financing, reorganization, sale of assets, or transfer of the Service, subject to applicable law. There are no third-party beneficiaries. Headings are for convenience only. Notices and agreements may be provided electronically. Provisions that by their nature should survive termination will survive, including those concerning ownership, payment obligations, disclaimers, liability, indemnity, disputes, and general terms.
15. Changes to these Terms
We may update these Terms from time to time. For material changes, we will provide reasonable advance notice by email, in-app notice, or another appropriate method. Changes take effect on the stated effective date and apply prospectively. If you do not agree to updated Terms, you must stop using the Service and cancel any subscription before they take effect.
